On July 23, 2010, the Michigan Supreme Court reversed the conviction and sentence of Brian Hill. Mr. Hill had been convicted of a 20 year felony using a computer to commit a felony.
The Michigan Supreme Court held that downloading images from the Internet and burning them onto CDRs was not production and was not distribution in the absence of an intent to distribute.
The Court ordered re-sentencing. Mr. Hill will be resentenced based on a 4 year felony for simple possession and a 7 year felony for using a computer to commit a felony.
